While Pennsylvania Strikes Down School Mask Mandate, Federal Judge Says Opposite in Tennessee

 

While children in Pennsylvania will soon be allowed to return to school without masks, children in Tennessee will not.

Over a 24-hour period, Pennsylvania’s highest court and a federal judge in Tennessee came to opposite conclusions about whether mask mandates should be legal.

According to WGALthe Pennsylvania Supreme Court struck down a mask mandate implemented by Democrat Gov. Tom Wolf’s acting Health Secretary Allison Beam, saying that Beam did not have the authority to implement such a mandate.

The court also reportedly said that Beam “did not follow state laws about enacting regulations and acted without a required existing disaster emergency declared by the governor in place.”

It upheld a lower court ruling which said that while Pennsylvania’s disease prevention law allows some latitude for the health secretary to prevent disease, the health secretary may not “create new rules and regulations out of whole cloth, provided they are related in some way to the control of disease or can otherwise be characterized as disease control measures.”

In other words, Beam exercised her authority too broadly in implementing a statewide school mask mandate, according to Pennsylvania’s courts.

Yes, Every Kid

Meanwhile, the story is different in Tennessee.

After legislators there passed a law allowing schools to opt out of mask mandates, a federal judge put a temporary stop on the enforcement of that law, meaning that schools may continue to mandate masks for their students.

According to Chief Judge of the United States District Court for the Middle District of Tennessee Waverly D. Crenshaw, his ruling “supports the public’s interest in mitigating the spread of COVID-19 in Tennessee’s schools.”

In September, parents filed a lawsuit against Gov. Bill Lee (R) and the Williamson County Board of Education challenging opt-out law, claiming that stopping schools from implementing mask mandates endangered the lives of students with disabilities.

In the same month, a rival group of parents filed a lawsuit against Williamson County Schools to end mask mandates altogether, claiming that the mandates are unconstitutional.

    I feel sorry for those without the resources to move on a whim.

    Warning, if TN goes DEM, I am OUT, I will move. And I will NOT be alone. — But, I will keep my lands, here, and lease it at an extraordinarily high Lefty-TN-adjusted rate. I will follow the Democrat City leadership way, and pillage my lands, as well. I will enact a “clear-cutting program”. And do away with 400 acres of hardwood, and SELL IT ALL, making way for high rise government housing! Along with a juicy multi-mega-million 50 year lease! — That IS the Democrat Way, after all! I would merely be doing what TN’s NEW voters want.

We must flip our major cities of Memphis, Chattanooga, Nashville; which are ALL Democrat Party controlled (and all are suffering for that choice!). And, now, even Knoxville is hard on the Democrat Party path to destruction.

    Soon, those FOUR cities large populations of Leftonuts will surpass ALL the rural lands, of TN. — At 50.01% of the vote, the remaining 97% of TN, will instantly be under DEM control. I will begin to move, and pillage. You will effectively begin losing the Second Amendment and pay higher taxes. Starting with no more Carry Laws, no Castle Laws, and no Stand Your Ground. And the day after that, higher taxes for ALL! to pay for social programs for SOME.

    The DEMS will ruin Tennessee.

    Stop the Democrat Party, NOW, while there’s still time.

    On February 4, 2015, President Barack Obama nominated Crenshaw to serve as a United States District Judge of the United States District Court for the Middle District of Tennessee, to the seat vacated by Judge William Joseph Haynes Jr., who took senior status on December 1, 2014.

    My question is this: Who sponsored Judge Crenshaw’s nomination in the U. S. Senate? Who? Was it Alexander? Corker? Or was it one of Tennessee’s Democrat congressmen–Cohen? Cooper? Tennessee has (had in 2015) a Republican legislature, a Republican Governor, a Republican majority delegation to both the U. S. Senate and the U. S. House of Representatives, but we continue to find ourselves with these left-wing Federal Judges for Tennessee. In this coming year of congressional redistricting, I think that the answer to my question concerning who sponsored Crenshaw’s nomination to the Federal bench for Tennessee would be important to know, don’t you think?
